1. Preamble
The company BlacklitchiⓇ sells and handcrafts paintings and posters from 100% original electronic or analog products. We exclusively market all our products through our website. We have decided to apply fundamental principles such as the rule of satisfaction or refund, clarity and longevity of offers, customer decision freedom, ease of ordering, and choice of delivery location.
2. Application of the General Terms of Sale
These general terms of sale apply to all orders placed on the Blacklitchi.fr website, reserving the right to adapt or modify these general terms of sale at any time. In the event of modification, the general terms of sale in force on the day of the order will apply to each order. Consequently, placing an order implies the buyer’s full and unconditional adherence to these general terms of sale (any order cannot be completed without validation of the general terms of sale).
3. Product Availability
Our product offers and prices are valid as long as they are visible on the website, within the limits of available stocks. Upon receipt of your order and validation of payment, we verify the availability of the ordered product(s). In case of unavailability, within 30 days from the validation of the order, we undertake either to deliver the ordered product, or to offer you a similar product at a similar price, or to refund you. You can request a full or partial refund upon simple request to our customer service if you do not wish to have a credit.
The date of order validation corresponds to:
- the date of the order in case of payment by online credit card.
- the date of receipt of payment by Paypal with validation.
- the date of receipt of the transfer with validation.
- In case of out-of-stock on one of the products in your order, we ship the rest of your order accompanied by an information message.
4. ORDER PLACEMENT
It is reminded that the secure ordering module implemented guarantees the technical authentication and integrity thereof. By express agreement between the customer and BlacklitchiⓇ, the validation of the order confirmation by the customer shall constitute a signature, irrevocable consent of the customer, and proof of the contract and knowledge of the prices. The customer will receive an email certifying the validity of the transaction made with BlacklitchiⓇ and will be legally bound upon receipt thereof. It is expressly agreed between the parties that a beginning of written proof of the contractual obligations may be provided by the computer records kept by Blacklitchi. This mode of proof, which the customer acknowledges as valid, is admissible, regardless of the amount of the order. Non-emancipated minors have residual capacity for acts that custom authorizes them to perform because of their modest nature. Consequently, any order made without the authorization of parents or legal guardians shall be presumed by their parents or legal guardians as not exceeding this modest character; otherwise, they shall provide authorization failing which their liability would be incurred.
5. PRICES
BlacklitchiⓇ reserves the right to change its prices at any time and without notice, but undertakes to apply the rates in effect which were indicated to you at the time of your order, subject to availability on that date.
These prices are stated net inclusive of taxes.
Retention of title clause:
The products remain the property of Blacklitchi until the full price has been collected by BlacklitchiⓇ. However, upon delivery, the risks of the delivered goods are transferred to the customer.
Default of payment:
Blacklitchi reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.
6. Delivery Terms
Delivery Time:
The order is delivered directly to the customer or to the address of their choice within 72 hours in most cases for metropolitan France within the framework of Standard delivery. This is an average time given as an indication depending on the destination, shipping method, and availability of the item. Exceeding this time frame cannot lead to any cancellation of the order, any reduction in the price paid by the buyer, and any payment for damages, provided that the customer is delivered within 30 working days following the confirmation of their order.
A longer period may be indicated on the order page, but in any case, the period cannot exceed 4 months, in which case, if this maximum period of 4 months is exceeded by more than 7 days without force majeure, the customer may terminate the contract by registered letter with acknowledgment of receipt. If an item becomes unavailable after ordering, BlacklitchiⓇ will inform the customer as soon as possible and will send them a higher or equal quality product sold at a lower or equal price in exchange, or will cancel the order and refund the customer. The customer cannot claim any different compensation in this regard.
In case of items deliverable at different dates depending on their availability, BlacklitchiⓇ reserves the right to split deliveries.
Delivery Method:
The ordered product is delivered by postal service or by an independent carrier, depending on the nature of the ordered product and at the exclusive initiative of the seller, to the delivery address indicated on the order form.

7. Receipt
Receipt is the act by which the recipient of goods takes possession of them at the time of their delivery by the supplier or a designated third party (carrier). It is done by a recipient. The delivery of the goods by the carrier is made in all cases against the signature of the recipient client on a delivery slip. In general, it materializes the transfer of ownership and triggers the payment of the commercial invoice according to the purchasing agreement made with the supplier.
Receipt of the goods thus puts the recipient face to face with two actors
Responsibilities:
the carrier who is responsible for damages and shortages occurring during transport, provided they are noted upon arrival of the goods and in the presence of the driver; the supplier who is responsible for the quality and quantity of the products delivered compared to the order.
The recipient is obliged to verify the conformity of the goods delivered at the time of delivery before signing the delivery slip. This verification is considered done as soon as the buyer, or a person authorized by him, has signed the delivery slip. Any anomaly regarding the delivery (damage, product missing compared to the delivery slip, damaged package, etc.) must be imperatively indicated on the delivery slip, accompanied by the signature of the inspector.
The inspector must indeed issue written, specific, and motivated reservations upon arrival on the delivery documents (waybill / delivery note, etc.) and in the presence of the driver (general formulas such as “subject to later verification” or “subject to unpacking” have no legal value).
The customer must confirm any anomaly by sending an email, fax, or registered letter with acknowledgment of receipt to the carrier or supplier according to each one’s commitment, stating all the complaints. The carrier’s contact details must be on the delivery slip. These complaints are transmitted 24 hours after delivery and before the following two days.
The verification of the condition of your package is considered done and compliant upon signing the delivery slip. Therefore, in case of non-compliance with all the indications listed above, no claim will be admissible. (Article L.133-3 of the Commercial Code).
If the products need to be returned to us, they must be returned within thirty working days following delivery. Any claim made outside of this period will not be accepted. The return of the product can only be accepted for products in their original condition (packaging, accessories, manual, etc.) and after obtaining a return number provided by our BlacklitchiⓇ service – Customer Service – Returns Department – 4 Rue Aristide Briand, 34250 Palavas-les-Flots.
Return shipping costs are the responsibility of the customer.
If at the time of delivery, the original packaging is damaged, torn, or open, you must then check the condition of the items. If they have been damaged, you must refuse the package and note on the delivery slip (package refused because open or damaged specifying the nature of the damage).
8. Return
In the case of a request for exchange or refund from the customer regarding the received product, if the product(s) is in accordance with the order, the customer will bear the return and reshipping costs. The exchange or full or partial refund will be made within a maximum of 10 days after checking/verifying the returned product if it has no defects.
In the case of product(s) not complying with the order, BlacklitchiⓇ will bear all the return and reshipping costs of the product(s) corresponding to the customer’s order.
9. Responsibilities
BlacklitchiⓇ cannot be held liable for non-performance of the contract in the event of fortuitous events, force majeure, disruption, or total or partial strike, notably of postal services, means of transport and/or communications, flood, fire. BlacklitchiⓇ shall not incur any liability for any indirect damages arising from these, loss of business, loss of profit, damages or expenses that may occur.
The choice and purchase of a product or service are the sole responsibility of the customer. The total or partial inability to use the products, particularly due to hardware incompatibility, cannot give rise to compensation, refund, or hold BlacklitchiⓇ liable. In the event of non-delivery of an order or part of an order, you have a maximum of one year (from the date of departure from our warehouse) to notify us. Beyond this period, we will not accept any claims.
10. Satisfied or refunded – right of withdrawal
In accordance with Article L221-18 of the Consumer Code, the consumer has a period of 14 working days from the date of delivery of his order to return any item that does not suit him and request an exchange or refund without penalties, except for return costs.
Before returning your product to us, you must indicate the reason(s) for the return, have your return agreement number by contacting customer service via our contact form. The product must be returned in good condition, with all accessories (manual, etc.) in its original packaging, and unused.
The right of return cannot be exercised for hygiene reasons for lingerie: therefore, any lingerie item will not be returned or exchanged, except in the event of a color or size error on our part.
Any return not benefiting from its number will not be accepted by our services. It will be automatically returned to you.
Return costs in the case of withdrawal will be at your expense.
